Welcome to Frontyard! These Terms of Use (“Terms”) govern your access to and use of the Frontyard mobile application, website, and all related services (collectively, the “Services”) provided by Frontyard Inc. (“Frontyard,” “we,” “us,” or “our”).
By creating an account, using the app, or accessing any part of the Services, you agree to be bound by these Terms. If you do not agree, please do not use Frontyard.
1. Who Can Use Frontyard
To use Frontyard, you must:
Be at least 13 years old
Have the legal capacity to enter into a binding agreement
Provide accurate account information and keep it updated
Use the Services in accordance with these Terms and applicable laws
2. Your Account
You are responsible for maintaining the confidentiality of your account credentials. Any activity that occurs under your account is your responsibility. If you suspect unauthorized access, please notify us immediately.
We may suspend or terminate accounts that violate these Terms or pose a risk to the platform or community.
3. Subscriptions & Payments
Frontyard may offer both free and paid subscription plans. Paid plans renew automatically unless canceled. By subscribing, you:
Authorize recurring charges to your selected payment method
Are responsible for any applicable taxes
May manage or cancel your subscription in your app store or account settings
We reserve the right to change pricing or features, but we’ll notify you in advance of any material changes.
4. Content You Submit
Frontyard allows users to create and share lists, upload photos, leave tips, and submit feedback (collectively, “User Content”).
By submitting User Content, you grant Frontyard a non-exclusive, worldwide, royalty-free, perpetual license to use, host, display, modify, distribute, and promote your content within the app, our website, social media, and promotional materials.
If your profile is public, we may include your name, handle, or profile image alongside your content.
You represent that you own or have permission to use any content you submit and that it doesn’t violate any laws or third-party rights.
5. Sponsored Content & Community Programs
Frontyard may feature branded content, sponsored lists, or events that offer rewards, discounts, or incentives to users. Participation is voluntary. Any promotions, prizes, or third-party rewards are subject to their own terms.
Frontyard is not responsible for sponsor-provided services or the fulfillment of third-party offers.
6. Use of the Services
You agree not to:
Upload unlawful, offensive, or infringing content
Scrape, download, or reverse-engineer any part of the platform
Attempt to impersonate another user or gain unauthorized access
Use Frontyard for any commercial activity not authorized by us
We reserve the right to monitor usage, remove content, or suspend access to protect the integrity of the platform.
7. Our Intellectual Property
All content and design elements created by Frontyard — including our logo, UI, curated location descriptions, and original visual elements — are the property of Frontyard Inc. and protected under U.S. and international intellectual property laws.
You may not copy, modify, distribute, or reuse any of our content without express written permission.
8. Feedback & Suggestions
We welcome your input — and we may use it! Any feedback, suggestions, or ideas you submit may be used by Frontyard for any purpose, without restriction or compensation.
9. Termination
You may delete your account at any time. We reserve the right to suspend or terminate your access if you violate these Terms or misuse the platform.
All licenses you grant us remain in effect after termination with respect to content already submitted or used.
10. Disclaimers
Frontyard is provided “as is” and “as available.” We do not guarantee that the Services will be uninterrupted, error-free, or meet your expectations.
We are not responsible for the accuracy of user-submitted content or third-party listings.
Use caution and your own judgment when exploring outdoor spaces.
11. Limitation of Liability
To the maximum extent permitted by law, Frontyard and its affiliates will not be liable for any indirect, incidental, or consequential damages related to your use of the Services — including loss of data, loss of access, personal injury, or damage to property.
12. Indemnification
You agree to defend, indemnify and hold harmless Frontyard Inc. and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password, or b) a breach of these Terms.
13. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding the Service.
14. Dispute Resolution
By using this Service, you agree that any disputes, claims, or controversies arising out of or relating to these Terms, the Service, or your relationship with Frontyard Inc. shall be resolved exclusively through final and binding arbitration, rather than in court. Arbitration will be administered by JAMS and held in Austin, Texas, in accordance with JAMS' rules and procedures. You expressly waive the right to file a lawsuit in court or to participate in a class action or representative action.
Each party agrees to resolve disputes on an individual basis and waives any right to bring claims as a plaintiff or class member in any purported class or representative action or proceeding. The arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a class or representative proceeding.
The arbitration will be conducted by a single arbitrator, and each party shall be responsible for their own attorneys’ fees. This provision shall survive the termination of this Terms and your relationship with Frontyard Inc.
15. Changes to These Terms
We may update these Terms from time to time. We’ll notify you of any material changes via email or in-app alert. Continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.
