Welcome to Frontyard! These Terms of Use (“Terms”) govern your access to and use of the Frontyard mobile application, website, and all related services (collectively, the “Services”) provided by Frontyard Inc. (“Frontyard,” “we,” “us,” or “our”). Frontyard is an app that passively tracks your time outside and shows your progress toward a daily goal.

By creating an account, using the app, or accessing any part of the Services, you agree to be bound by these Terms. If you do not agree, please do not use Frontyard.

1. Who Can Use Frontyard

To use Frontyard, you must:

• Be at least 13 years old
• Have the legal capacity to enter into a binding agreement
• Use the Services in accordance with these Terms and applicable laws

2. Your Account

You sign in to Frontyard with your Apple or Google account. You are responsible for keeping that account secure. Any activity that occurs under your account is your responsibility. If you suspect unauthorized access, please notify us immediately.

We may suspend or terminate accounts that violate these Terms or misuse the Services.

3. Subscriptions & Payments

Using Frontyard requires a subscription. You subscribe in the app, through the Apple App Store or Google Play, and choose a monthly or annual plan. You pay the price shown in the store when you subscribe, in your local currency. By subscribing, you:

• Authorize the store to charge your payment method on a recurring basis
• Are responsible for any applicable taxes
• Agree to the store’s own terms for purchases made through it

Free trial. The free trial is the store’s offer. Where one is offered, it is available only to new subscribers, and the store decides its length and whether you are eligible; both are shown before you confirm. A payment method is required to start a trial. When the trial ends, your subscription starts and you are charged, unless you cancel before the trial ends.

Renewal. Your subscription renews automatically at the end of each monthly or annual period, at the price then shown in the store, unless you cancel before the period ends. On the App Store, you need to cancel at least 24 hours before the end of the period.

Cancellation. You cancel through the store you subscribed with, in your phone’s subscription settings; our Support page shows how. Deleting the app does not cancel your subscription. Deleting your Frontyard account does not cancel it either. When you cancel, you keep access until the end of the period you have paid for, and you are not charged again.

Refunds. Payments are made to Apple or Google, so refunds are handled by them under their policies.

Price changes. We may change our prices. A new price applies from your next renewal, and the store will notify you of it as its rules require.

Complimentary access. We may give selected people complimentary access to Frontyard, with no charge and no store subscription. Complimentary access never turns into a charge, and we may end it at any time.

We reserve the right to change features, but we’ll notify you in advance of any material changes.

4. Content You Submit

When you name a Known Place, correct an outdoor session, send a sample, or send us feedback, you grant Frontyard a non-exclusive, worldwide, royalty-free, perpetual license to use that content to operate and improve the Services, as described in our Privacy Policy.

When you share your progress to Instagram, Facebook or anywhere else, what you share is yours; the service you share it to has its own terms.

5. Use of the Services

You agree not to:

• Scrape, download, or reverse-engineer any part of the Services
• Attempt to impersonate another user or gain unauthorized access
• Interfere with the Services or try to get around the subscription
• Use Frontyard for any commercial activity not authorized by us

We reserve the right to monitor usage, or suspend access to protect the integrity of the Services.

6. Our Intellectual Property

All content and design elements created by Frontyard — including our logo, UI, and original visual elements — are the property of Frontyard Inc. and protected under U.S. and international intellectual property laws.

You may not copy, modify, distribute, or reuse any of our content without express written permission.

7. Feedback & Suggestions

We welcome your input — and we may use it! Any feedback, suggestions, or ideas you submit may be used by Frontyard for any purpose, without restriction or compensation.

8. Termination

You may delete your account at any time, from the app. We reserve the right to suspend or terminate your access if you violate these Terms or misuse the Services.

All licenses you grant us remain in effect after termination with respect to content already submitted or used.

9. Disclaimers

Frontyard is provided “as is” and “as available.” We do not guarantee that the Services will be uninterrupted, error-free, or meet your expectations.

Frontyard estimates your time outside from your phone’s sensors, and an estimate can be wrong. The UV figure describes the ultraviolet that was in the air for a coarse area while you were out, not what reached your skin. Nothing in Frontyard is medical advice.

Use caution and your own judgment when spending time outdoors.

10. Limitation of Liability

To the maximum extent permitted by law, Frontyard and its affiliates will not be liable for any indirect, incidental, or consequential damages related to your use of the Services — including loss of data, loss of access, personal injury, or damage to property.

11. Indemnification

You agree to defend, indemnify and hold harmless Frontyard Inc. and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password, or b) a breach of these Terms.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding the Service.

13. Dispute Resolution

By using this Service, you agree that any disputes, claims, or controversies arising out of or relating to these Terms, the Service, or your relationship with Frontyard Inc. shall be resolved exclusively through final and binding arbitration, rather than in court. Arbitration will be administered by JAMS and held in Austin, Texas, in accordance with JAMS’ rules and procedures. You expressly waive the right to file a lawsuit in court or to participate in a class action or representative action.

Each party agrees to resolve disputes on an individual basis and waives any right to bring claims as a plaintiff or class member in any purported class or representative action or proceeding. The arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a class or representative proceeding.

The arbitration will be conducted by a single arbitrator, and each party shall be responsible for their own attorneys’ fees. This provision shall survive the termination of this Terms and your relationship with Frontyard Inc.

14. Changes to These Terms

We may update these Terms from time to time. We’ll notify you of any material changes via email or in-app alert. Continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.
